New engine

Looking for some advice, Edin HD have ordered a new engine for me, it's coming from Belgium ? (contribution reduced from 50% to 40% since it's a replacement and not a repair) but i was just wondering, who owns the old engine? HD have told me it's a goodwill gesture and not a warranty claim so could i ask for the old parts back and keep any parts not completely knackered for spares, or does it belong to the dealer/HD.?
Your thoughts please o knowledgeable ones.

Their contribution is now 40%!!!!
The profit on the engine is probably as much as that so their contribution is probably 0%.

As it's not a warranty job the old kit will not go back to HD so I would say any old parts are yours. But they will very likely try to keep them for employees or dealer used parts.

It has not been a happy experience reading about this, so must have been hell to experience first hand! The Blair/Brown government would be proud of the way this has been handled by Harley, with such an obscure interpretation of their duties to you the customer.

I suspect you will never see any of your old engine again, but encourage you to try to get it back. If it was a warranty claim their ownership of the old engine would be more clear, but doing things as they have (to avoid any other liability to you) you have a case to claim it as yours.

If you have any fight left in you, have a go!

This is black and white. The title to the engine today is yours. That is not in dispute.
If the delarer has made a goodwill gesture to cover part of the replacement costs, that does not affect your ownership of the engine. It's yours, and you should assert your rights to it. However, it would be wise to make sure that you have a firm offer in writing from the dealer as to exactly what they are offering, and how much it's going to cost you.
If there is no proviso in there, the engine is still yours.
They could, if they wanted to be absolute barstewards, give you the engine and charge you for removing it, but is that likely?
If you're still on speaking terms with them, a friendly discussion about the subject might be the best solution, as pre-agreement is always better than conflict resolution. Good luck!

If they want to keep 40% of the stuff that comes off, let them have the old oil, filter and gaskets.

Its your engine, keep it.

They already are charging me for the initial strip down and inspection, there is no contribution towards that.
I might seem like a moaner but i'm not really. I do appriciate that i did not buy the bike from an HD Dealer and as such it is a goodwill gesture but i'm missing all the good weather after riding throughout the sh..y winter months, my wifes 6 months pregs with our first girl, my and my other two boys are driving me mad,I need my bike back for my sanity.:sca red2:

Urrell, my thoughts exactly on what would happen to the engine parts. Thanks for the advice once again.

(it's always useful to know of a place that is good & helpful)

If they don't, you will tell all of us that they are crap --- WON'T YOU

If you are getting a numbers matched engine, you are going to have to give up the old case half with the engine number on.

If not, its all yours.
