Theft and claim not bike related

I had to replace my laptop with a new on which I had my laptop stolen last year in Haiti.

The organization I worked for required me to use my own computer.

This was stolen by a Local member of staff.

I reported the loss to the police in Haiti and received a crime number. After about three weeks the computer mysteriously turned up, but completely wrecked the screen had been ripped of and was beyond economic repair.

Because I used the computer for work my home policy did not cover the loss neither would the organization I worked for cover me as the computer was returned albeit in an unusable condition.

In between all of this I purchased a new laptop, in Haiti for $650.00.

My ex employer is claiming from me $900.00 us dollars for a flight home which was evidently was above my allowance.

My argument is I have lost my original computer which cost me over £700.00, a Compaq Presario 5000 and I also had to abosrb the cost of replacing my computer at $650.00, In my mind I have had to purchase computers at over a £1000.00 and in fact they owe me money.

Thier argument is based on I'm replacing a computer like an insurance claim I cant make them see I have incurred two sets of costs..

Am I right...?????

The Compaq Presario 5000 is an old laptop and whilst you may have paid £700 for it at some point it's value at the time of it's demise would be less. You replaced the laptop with a new one at $650 (let's call it £450) and still have the use of it.

I would say that your losses are limited to the cost of the new laptop at best.

You only have had to pay out for the new computer to replace the stolen one or did you not bring that home either?

You spent £700 on a computer. That was yours.
It was stolen, meaning you were down one computer.
You spent £400 ($650) on another computer. You're now back to one computer (dunno if t's comparable or not), but down £400 ($650).

You're loss is £400 ($650) plus or less any difference in the standard of comp, so your employer owes you that £400 ($650) plus orminus the difference in value.

The travel issue is separate (£600 / $900), but if you accept that you owe for it, and want to offset one against the other, you owe them £200 / $250.

If a condition of employment was that you supplied your own computer,it's just the same as supplying your own safety footware or hard hat on a site.
If you turn up and say they've been stollen,they'd say go home and come back when you've replaced them.
As far as I can see,the condition of your first computer when it was returned,is of no concern to the company.You've either got a working computer,and a job,or you've got neither.
The $900 is a completely different issue.If you were allowed trips home as part of your pay and conditions,it should be in writing,so "evidently" doesn't come into it.You were within the stated allowance,or you weren't.

To sum up,the computer is a lost cause,the $900 is dependant on the wording of your contract.
