If you are in the AA or RAC try them for advice. Motoring organisations have lawyers that will have often dealt with this type of case. Trading standards tend to be a bit varying in quality. Good Luck.

I would like to point out that my reply deemed to be "non-serious" was actually a factual point of grammar and totally serious.

It also was specifically pertaining to a potential litigious response to this thread, the fact that it involved word-play was meant to lighten the message.

A verbal contract is binding in law. Did anyone witness teh conversation of agreement? These are the lines your firend will need to think along, but a proper solicitor is what they need to outline their options and guide their actions.

........Mike, I really don't want to make a bad situation worse but, a verbal contract ain't worth squat unless you can reasonably prove a conversation took place and a consensual agreement was reached by both parties. For example, if I said, "Mike sell my bike for me and you can keep 20% of the sale price." You agreed then kept 40% of the sale price because you stored my bike for 4 months while trying to sell it. I'd be stuffed because I'd have to prove I said 20% and you heard 20% and also no mention of storage fees was discussed; this is why we have written contracts that set out the terms of the contract. I may have felt what I was said to you was clearly understandable and you may have felt adding 20% for storage was so obvious it didn't need mentioning. The net result is both parties thinking they understand the verbal contract prior to the sale only to find out their post-sale understanding is somewhat different. To be brutally honest, anyone who asks someone (including their best friend) to sell something for them without a written contract is being extremely naive.

Sure, Mark. That's why I asked whether anyone had witnessed it. If anyone did, that's half the job done. It wouldn't cover percentage commission, but would clarify that an agreement to act as agent for sale and not an actual sale was what had been agreed. You can get ambiguities in wrtitten contracts causing the same sorts of misunderstandings you've mentioned. That's why you usually pay someone with a functioning brain a few bob to write them.....

I heard that the latest on this thread was that June got her money back after Brian had a visit from two err... "Gentlemen"!
I sincerely hope that this is the case, as this kind of shit should never happen to nice people.

My advice on selling through a dealer, is to make sure you establish IN WRITING, what the terms of the deal are.
This constitutes a CONTRACT.
Make sure you keep a copy.
Don't sign the F*****g log book until you get the F*****g dosh.
Make sure the dealer sends the yellow part of the log book to DVLA so you don't get some other buggers speeding tickets.
